Waiver of Liability and Assumption of Risk Agreement
Waiver:
In consideration of my, or my Child or Ward’s (“Child”) participation in the lacrosse tournament, training, practice, and/or use of any premises, for such lacrosse event being held, sponsored, and led by Take Your Spot LLC; I, the undersigned, on behalf of my Child, and for myself, my heirs, personal representative or assigns, do hereby release, waive, discharge, and covenant not to sue, and hold harmless Take Your Spot LLC, its members, trustees, directors, officers, employees and agents, and I agree to indemnify and hold them harmless from liability for any and all claims including negligence, but excluding willful or intentional acts, that may result in personal injury, accidents, or illnesses (including death) and property loss arising from such participation in the lacrosse tournament, training, practice, and/or use of any premises where such activities are conducted.
Assumption of Risk:
Playing lacrosse and participating in all activities related to lacrosse carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. I have read the previous paragraph, and I know and understand and appreciate that there are risks inherent in the activity I am participating in. I hereby assert that my participation is voluntary and that I knowingly assume all such risks.
Indemnification and Hold Harmless:
I agree to indemnify and hold harmless Take Your Spot LLC, its members, trustees, directors, officers, employees and agents from any and all claims, actions, suits, costs, expenses, damages and liabilities including attorney fees incurred as a result of any claim that may arise from my (or my Child’s) participation in the lacrosse tournament, training, practice, and/or use of any premise where such activities are being conducted.
Severability:
The undersigned further expressly agrees that the forgoing waiver and assumption of risk agreement is intended to be as broad and inclusive as is permitted by the law of the State of Maryland and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
